If these laws start flying I don't see why cigarettes couldn't be exempted from federal regulation. The federal government could argue it has the power to regulate tobacco because it causes cancer which affects health care costs which affects interstate commerce. But then they'll open themselves up for challenge on why they are involved in health care (another power not enumerated in the Constitution).

We need this law in virginia ..but i think the court sided with the fed about the medical cannabis law because the product 'may ' end up crossing state lines .. i may be wrong about that ruling ..and i hope i am but if this does work we need to get this legislation passed every where as quickly as possable .. but if this law is valid why do we have to pay federal tax on smokes made in virginia and consumed in virginia .. could we produce a brand of ciggs' that are only to be distributed in the state to avoid a federal tax on tobaco ???
